FAWN RIDGE MAINTENANCE ASSOCIATION
AMENDED AND RESTATED OF RECEPTACLES & DEBRIS RESOLUTION
WHEREAS, the Board of Directors of Fawn Ridge Maintenance Association (the “Association”)
is empowered to make and enforce rules regarding maintenance and the control of nuisance
conditions within the community; and
WHEREAS, the Association adopted a Trash Can Resolution on October 14, 2014, establishing procedures for the storage of trash containers; and
WHEREAS, effective July 1, 2024, the Florida Legislature enacted House Bill 1203, amending
Chapter 720, Florida Statutes, which prohibits a homeowners’association from levying a fine or
suspension against a parcel owner for leaving garbage receptacles at the curb or end of the
driveway less than twenty-four (24) hours before or after the designated garbage collection day
or time; and
WHEREAS, the Board finds it necessary to amend the Trash Can Resolution to bring it into
compliance with Section 720.305, Florida Statutes, while continuing to address the diminishment in community aesthetics caused by the improper storage of trash containers after Collection;
NOW, THEREFORE, BE IT RESOLVED that the Receptacles & Debris Resolution formerly known as Trash Can Resolution adopted October 14, 2014, is hereby amended and restated in its entirety as follows:
1. Placement for Collection.
Trash & recycling receptacles and debris may be placed at the curb no earlier than twenty-four (24) hours before the scheduled collection time established by the Hillsborough County Solid Waste Contractor.
2. Retrieval After Collection.
Trash & recycling receptacles and debris shall be removed from the curb and stored away from community view no later than twenty-four (24) hours after the scheduled collection time established by the Hillsborough County Solid Waste Contractor.
3. Storage Location and Screening.
At all other times, trash & recycling receptacles and debris must be stored and screened from view within the garage, or on the side or rear of the home. Acceptable screens include landscaping and fencing. An Architectural Review Committee (“ARC”) approval is required prior to the installation of any such screening. In no event shall any receptacles and/or debris be stored in front of the Home or in any other location where they are visible from the parcel’s frontage, any adjacent parcel, or any adjacent common area.
4. Enforcement.
Violations of this Resolution shall be enforced in accordance with Section 720.305, Florida Statutes, and the Association’s governing documents, including the notice, hearing, and fine procedures required by law. No fine or suspension shall be imposed for conduct expressly protected under Section 720.305(2), Florida Statutes.
5. Severability.
If any provision of this Resolution is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
6. Effective Date.
This Amended and Restated Resolution shall take effect immediately upon approval by the Board of Directors and shall supersede the Trash Can Resolution adopted October 14, 2014, in its entirety.
